Can I Choose Which Parent to Live with in Canada?

You can say what life in two homes feels like. If you live in Canada, adults should listen to your views. You do not have to settle the disagreement between your parents.

Is there an age when I decide?

There is no single birthday that gives every child in Canada the right to choose a home alone. In divorce cases, the court considers your views according to your age and maturity, alongside your needs and safety.

Other cases use provincial or territorial rules. Adults can help you understand how your views will be heard.

What can I say?

You do not need to make a legal argument. You can talk about:

  • How travel affects school and sleep.
  • Missing friends, siblings or a parent.
  • Wanting to understand the plan.
  • Anything that makes you feel unsafe.

Will I have to take sides?

You should not be made responsible for choosing a winner. An adult or professional may help explain your views to the court.

It is possible to love both parents and want something about the arrangements to change.
